Repeal McCarran-Ferguson Antitrust Exemption for Insurance Companies

Senator Patrick Leahy (D-VT), Chairman of the Senate Judiciary Committee, announced on May 6, 2010, that he is offering an amendment to S. 3217, the Restoring American Financial Stability Act of 2010, language to overturn the McCarran-Ferguson Act as it applies to health insurers and subjecting them to federal antitrust regulation by the Federal Trade Commission (FTC) and the Department of Justice (DOJ) for the first time.  Senator Leahy has long supported overturning McCarran-Ferguson, which was passed in 1945 and reserves as the domain of the States the regulation of the "business of insurance."  His amendment has the support of most Democrats in the Senate.

Earlier this year, on February 24, 2010, the House passed by a vote of 406-19 the Health Insurance Industry Fair Competition Act (H.R. 4626) to overturn McCarran-Ferguson as it applies health insurers. President Obama supports this provision and has promised to sign it into law if it can pass the Senate.

Impact on General Dentistry:  The McCarran-Ferguson Act has sheltered health insurers from federal antitrust laws and permitted them to engage in anticompetitive practices that harm patients and health care providers.  Overturning this law will level the playing field between general dentists and dental benefit plans by addressing price fixing, bid rigging, and market allocation.  The AGD strongly supports the Leahy amendment.

Finally getting all caught up from a few days at CDA and a few more with the Speakers Consulting Network. 
Here are some of the things that caught my eye while roaming the exhibit floor.

Dentsply is waiting on FDA 510 approval of their MTM System.  This is a new clear aligner system that is less expensive then other systems. More information is available on web site.

Technology4Medicine has announced their new 1064XLase. This is a 1064nm 10 watt diode laser.  Its will sit on your counter. The coolest thing is the on board video guidance. If you need a refresher on preforming a procedure you can view the video right on the control screen.

Doctorbase is a patient review site that integrates with Social Networks such as Twitter and Facebook. This automates word of mouth referrals.

Dentrix released Dentrix Mobile, a remote access tool that allows dentists to view their appointment schedules and patient information from their smartphones and mobile devices. Dentrix Mobile is a new feature of the Dentrix G4 practice management system that provides dentists who are away from their practice secure access to the schedules of all their practice providers and patients, as well as important patient details such as prescriptions and medical alerts.

Different types of X-ray equipment are used in dental radiology, such as intra-oral, panoramic, cephalometric, cone-beam computed tomography (CBCT) and multi-slice computed tomography (MSCT) units. Digital receptors have replaced film and screen-film systems and other technical developments have been made. The radiation doses arising from different types of examination are sparsely documented and often expressed in different radiation quantities. In order to allow the comparison of radiation doses using conventional techniques, i.e. intra-oral, panoramic and cephalometric units, with those obtained using, CBCT or MSCT techniques, the same quantities and units of dose must be used. Dose determination should be straightforward and reproducible, and data should be stored for each image and clinical examination. It is shown here that air kerma–area product (PKA) values can be used to monitor the radiation doses used in all types of dental examinations including CBCT and MSCT. However, for the CBCT and MSCT techniques, the methods for the estimation of dose must be more thoroughly investigated. The values recorded can be used to determine the diagnostic standard doses and to set diagnostic reference levels for each type of clinical examination and equipment used. It should also be possible to use these values for the estimation and documentation of organ or effective doses.

Ex-inmate with bad gums can sue over no toothpaste

Prison can be tough on the gums.
A former Michigan inmate who claims he was denied toothpaste for nearly a year can sue prison officials, citing his constitutional right against cruel and unusual punishment, a federal appeals court said.
Jerry Flanory, of Flint, says he developed gum disease and had a tooth removed in 2006 as a result of no toothpaste. The appeals court reinstated his lawsuit Thursday against officials at the Newberry prison in Michigan's Upper Peninsula.
"This court has found dental health to be of great importance," a three-judge panel said, citing a past decision from the 6th U.S. Circuit Court of Appeals.

Intraoral laser welding: ultrastructural and mechanical analysis to compare laboratory laser and dental laser

The Nd:YAG laser has been used since 1970 in dental laboratories to weld metals on dental prostheses. Recently in several clinical cases, we have suggested that the Nd:YAG laser device commonly utilized in the dental office could be used to repair broken fixed, removable and orthodontic prostheses and to weld metals directly in the mouth. The aim of this work was to evaluate, using scanning electron microscopy (SEM), energy dispersive X-ray spectroscopy (EDS) and dynamic mechanical analysis (DMA), the quality of the weld and its mechanical strength, comparing a device normally used in dental laboratory and a device normally used in the dental office for oral surgery, the same as that described for intraoral welding. Metal plates of a Co-Cr-Mo dental alloy and steel orthodontic wires were subjected to four welding procedures: welding without filler metal using the laboratory laser, welding with filler metal using the laboratory laser, welding without filler metal using the office laser, and welding with filler metal using the office laser. The welded materials were then analysed by SEM, EDS and DMA. SEM analysis did not show significant differences between the samples although the plates welded using the office laser without filler metal showed a greater number of fissures than the other samples. EDS microanalysis of the welding zone showed a homogeneous composition of the metals. Mechanical tests showed similar elastic behaviours of the samples, with minimal differences between the samples welded with the two devices. No wire broke even under the maximum force applied by the analyser. This study seems to demonstrate that the welds produced using the office Nd:YAG laser device and the laboratory Nd:YAG laser device, as analysed by SEM, EDS and DMA, showed minimal and nonsignificant differences, although these findings need to be confirmed using a greater number of samples.

Objective: To evaluate the shear bond strength of orthodontic brackets bonded to bovine enamel using a new curing appliance composed of an LED cluster.
Design: In vitro, laboratory study.
Materials and methods: Standard edgewise maxillary central incisor metal brackets (0·022'' slot) were bonded to 60 bovine incisors which were arranged in a parabola, simulating the dental arch. The arches were randomly allocated to one of five groups: three experimental groups in which a half arch was cured using the Whitening Lase Ortho LED Cluster light for 10, 20 and 40 s (EG10s, EG20s, EG40s) and two control groups. Control group 1 (CGH) were cured using a halogen light for 20 s and control group 2 (CGL) were cured using a conventional LED light for 20 s per tooth. A shear debond test was performed using an EMIC machine and the results were analyzed by ANOVA and post hoc Tukey multiple comparisons. The Adhesive Remnant Index (ARI) was determined at 10x magnification.
Results: The one-way ANOVA showed a statistically significant difference between the groups (P<0·001). The post hoc Tukey comparison showed that the bond strength for group EG10s was significantly lower than both the control groups CGH (P<0·001) and CGL (P<0·001). There was no significant difference between the bond strengths for groups EG10s and EG20s (P = 0·100). Neither were there any statistically significant differences detected between groups EG20s, EG40s, CGL and CGH (P>0·05).The ARI analysis revealed a higher frequency of score 2 for groups CGL, EG10s, EG20s, a higher frequency of score 0 and 1 for the CGH group and a score of 1 was most frequent for the EG40s group.

Morton Rosenberg, DMD, of Tufts University School of Dental Medicine and an expert on dental anesthesiology, integrated existing guidelines with new information to create an updated list of emergency medications and equipment for dental providers, including an emergency preparedness checklist.

"Every dentist will likely manage a medical emergency during the course of their practice. Planning for such an emergency involves preparing and educating clinical staff, ensuring that medical equipment is accessible and functional, and stocking emergency medications," said Rosenberg, professor in the department of oral and maxillofacial surgery and head of the division of anesthesia and pain control at Tufts University School of Dental Medicine.

Rosenberg provides an updated emergency preparedness checklist to prepare dental providers for medical emergencies that may occur in the clinical setting, as well as a detailed list of emergency medications and equipment. Medical emergencies that may occur in a clinical setting include allergic reaction to medications, hyperventilation, or heart attack.

Rosenberg advises that specific medications be stocked and regularly checked to ensure they have not exceeded their expiration dates, including oxygen, epinephrine, nitroglycerin, glucose and reversal drugs. He proposes a list of emergency medical equipment to be readily available and accessible, including an automated external defibrillator (AED) and a portable oxygen delivery system. In the paper, Rosenberg details the appropriate actions and administration of medication and uses of equipment based on the medical emergency.

"Emergency preparedness includes adequate training so that dentists and staff respond reflexively to an emergency situation and facilitate better diagnosis and care of the patient," said Rosenberg.

The paper is published in a supplement on medical emergencies in the May 2010 issue of The Journal of the American Dental Association.

Rosenberg is a professor of oral and maxillofacial surgery and head of the division of anesthesia and pain control at Tufts University School of Dental Medicine. He is also an associate professor in the department of anesthesiology at Tufts University School of Medicine. Rosenberg is the co-author of a textbook, entitled Medical Emergencies in Dentistry.

Resin-modified glass ionomers (RMGI) have demonstrated clinical success providing immediate and long-term relief from root sensitivity. RMGIs have been recently introduced as paste-liquid systems for convenience of clinical usage. The objective of this study was to measure the ability of a new paste-liquid RMGI to reduce fluid flow through human dentin, compared to an established single-bottle nanofilled total etch resin adhesive indicated for root desensitization.
Dentin permeability was measured on human crown sections on etched dentin, presenting a model for the exposed tubules typical of root sensitivity, and permitting measurement of the maximum permeability. In the first two groups, the etched dentin was coated with either the RMGI or adhesive, and permeability measured on the coated dentin. In a third group, a smear layer was created on the dentin with sandpaper, then the specimens were coated with the RMGI; permeability was measured on the smeared and coated dentin. Specimens from each group were sectioned and examined via scanning electron microscopy (SEM).
Both the resin adhesive and the new paste-liquid RMGI protective material significantly reduced fluid flow through dentin, and exhibited excellent seal on dentin with either open tubules or smear-layer occluded tubules. The RMGI infiltrated the smear layer with resin during placement, penetrated dentin tubules, and formed resin tags.
The RMGI was equivalent to the adhesive in its ability to reduce fluid flow and seal dentin. It is therefore concluded that the new RMGI and the adhesive show the potential to offer excellent sensitivity relief on exposed root dentin.

Chronic trauma of the oral mucosa may lead to cancer

Background: Oral cancer represents 2%–5% of all cancers, being one of the 10 most frequent ones. Apart from oral cancer risk factors already described in literature, such as tobacco and alcohol consumption, others emerging risk factors have been proposed, such as chronic irritation from dental factors. The aim of this work was to assess the influence of chronic trauma of the oral mucosa (CTOM) in patients with oral potentially malignant disorders (OPMD) and cancer.
Methods: A retrospective study of 406 patients (both sexes; aged between 18 and 80 years; with OPMD and cancer) who attended the Department of Clinical Stomatology A of the National University of Cordoba was performed by non-probabilistic sampling. The association of variables and outcome variable diagnosis, with levels control, OPMD, oral cancer, was evaluated by multinomial regression model.

Results: Population under study was represented by 72% of control patients, 16% patients with OPMD and 11% of patients with oral cancer. It was observed a significant association between diagnosis and CTOM (= 0.000), after adjustment of confounding factors (smoking and drinking habits, sex, cancer inheritance and denture use).

Conclusions: Our results suggest that CTOM is, together with other factors, an important risk factor in patients with oral cancer diagnosis, but not for patients with OPMD.
